DOVER — A Superior Court judge ruled the state can’t compel Foster’s Daily Democrat to release an unpublished jailhouse interview, in the process setting New Hampshire precedent for cases involving the media, the First Amendment, and the privilege afforded to nonconfidential sources.
In a ruling released Tuesday, Strafford County Superior Court Judge Steven Houran wrote that forcing Foster’s to turn over unpublished work product would have a negative effect that goes beyond violating the state and federal constitutional freedoms afforded to the press.
